Acknowledgment of Risks and Releases of Liability

Introduction:
Soft washing involves the use of low-pressure equipment and caustic chemicals to effectively remove tough stains from exterior surfaces. While this method yields excellent cleaning results, it is important to understand that operating at low pressure carries inherent risks, which this agreement aims to address.

Ganir Professional Services:
Ganir Professional Services is committed to the safe and responsible use of soft washing equipment. Our team is well-trained and takes utmost care to minimize any potential harm to your property. While we do not employ high pressure on residential siding, it is crucial to recognize that damage can still occur due to factors beyond our control, such as inadequate maintenance, property neglect, or the use of low-quality building materials.

Homeowner’s Responsibility:
The homeowner is responsible for ensuring that their property adheres to the manufacturer’s maintenance recommendations. Any defects or areas of concern should be addressed and repaired before soft washing to maintain a watertight surface. By acknowledging these responsibilities, the homeowner accepts all associated risks and assumes responsibility for any damage that may result from the aforementioned factors.

Release of Liability – Property Damage:
The Client hereby releases Ganir Professional Services from any liability for property damage resulting from soft washing services, as long as Ganir Professional Services has operated within the parameters of industry standards and guidelines.

Release of Liability – Personal Injury:
The Client also agrees to release Ganir Professional Services from any liability for injuries sustained as a result of equipment placement, which may include but is not limited to injuries from tripping or falling, contact with equipment, falling debris, or other equipment-related incidents.

Client Responsibility On The Day of Service:

Ensure Accessibility to Water Spigot:
Please ensure that the water spigot is activated and easily accessible for our team to use during the service.

Pets and Safety:
For the safety of your pets and our workers, have all pets inside the property during the appointment and for at least two hours after the workers have completed their work.

Clear Work Areas:
Clear the work areas of all items, vehicles, or any sensitive materials, from the areas to be washed.

Property Water-Tightness Responsibility:
The Client is responsible for ensuring the water-tightness of their property.

Responsibility for Exterior Apertures:
The Client must ensure that all outside electrical outlets and fixtures are shut off and sealed before the service.

Surface Sensitivity Notification:

  • The Client must inform the company of any sensitive surfaces on or near the roof.
  • The company is not liable for any effect on surfaces if not notified in advance.

Protection from Overspray:
The Client must move any items susceptible to overspray or run-off during the service.

Responsibility for Coatings and Surfaces:

  • The Client is responsible for the color-fastness of all exterior coatings, including paints, stains, and other materials.
  • Any pre-existing defects with the property are the responsibility of the Client.

Roof Cleaning Process Clarification:

  • The company primarily uses a soft washing method for roof cleaning.
  • The Client acknowledges that the roof’s response to the cleaning solution may vary and that complete removal of growth may take time.
  • Granular loss is a normal occurrence over time, especially in areas with organic growth.

Handling of Remaining Algae:

  • The Client may observe light brown areas after treatment, which are remnants of the cleaned algae.
  • It may take several weeks for the remaining algae to fade naturally.
  • If the brown areas persist after 6 to 8 weeks, the Client should contact the company for further action.

Roof Wash Inclusions:

  • The service includes using a cleaning solution of water, detergent, surfactant, and sodium hypochlorite,
  • The soft washing method with low pressure will be used to eliminate organic matter from the roof.

Roof Wash Exclusions:

  • The service does not include a house wash.
  • Surface cleaning, such as driveways, walkways, patios, porch floors, and pool decking, is excluded.
  • Fence and deck cleaning are not part of the service.
  • There is a $50.00 cancellation fee if notice is not given within 24 hours of service, or if the Company arrives and cannot wash due to steps1-10 not being completed.
  • There is a $50.00 processing fee for any returned checks.
  • This agreement to provide services is in no way a guarantee that stains will be removed completely. The Company does strive for 100% customer satisfaction and will work with homeowners when this does not occur.

Corrections of Damages

Ganir Professional Services shall only be obligated under this Contract for structural damages which are a direct result of operator error, gross negligence, or willful misconduct. Damages must be discovered and reported within three calendar days of said completion. Upon receipt of written notice, the Company shall be allowed 30 calendar days from date of receipt for the purpose of inspecting the premises. Ganir Professional Services shall have sole option of repairing or contracting repair work to correct any structural damages that are a direct result of the Company. If repair is not possible beyond the company’s ability, a business insurance claim may be requested.

Weather Condition

Our service is contingent on weather conditions. In the event of cloudy or rainy weather, we may need to reschedule for optimal results.

Payment Terms

Payment is due when work is completed unless alternate arrangements have been made and initiated on the service agreement. Currently Ganir Professional Services is only accepting cash and/or check payments only. Should Client utilize a credit card for payment, a 2.5% processing fee will be assessed.

Collection of Outstanding Debt

Ganir Professional Services reserves the right to attach a mechanic’s lien against a homeowner’s property for non-payment. At 30 days past due, a formal notice of intent to file this lien will be sent via registered mail. Interest rate of 2% per month begins accruing after day 31 of non payment. Ganir Professional Services also reserves the right to enter into civil claims court to collect outstanding debt. All legal fees incurred will be added to the remaining unpaid balance. This contract is binding.

Agreement to Terms

By accepting an estimate, the Client agrees that all the specifications and conditions are satisfactory and hereby accepted. You authorize Ganir Professional Services to do the work as specified on the proposal/estimate form. You release Ganir Professional Services from property damage unless damage is caused by gross negligence or willful misconduct. Ganir Professional Services is not responsible for damage to loose siding, windows, paint or wood trim. Any damages due to the above are the responsibility of the owner.

Conclusion:

By signing this acknowledgment of risks and release of liability, the Client acknowledges that they have read, understood, and accepted the potential risks associated with soft washing. The Client also agrees to hold Ganir Professional Services harmless from any claims, damages, or liabilities arising from the soft washing services provided.

Governing Law:

This Agreement shall be governed by and construed in accordance with the laws of [HI, US]. Any disputes arising out of this Agreement shall be subject to the exclusive jurisdiction of the courts in [Kauai, Hawaii, United States].
